Altior Law obtained a significant and exceptional victory for its client in December 2019 – an order granting a motion to set aside a jury verdict. Following a June 2018 judgment, based on a jury verdict that imposed liability on its client, in June 2019, Altior Law filed a motion to set aside the judgment based on fraud or other misconduct of a party. The factual basis for the motion was information brought forward by a (previously concealed) witness that the key piece of evidence relied upon by the plaintiff at the trial was manufactured and backdated. The trial court initially issued an order holding the motion in abeyance while it allowed for a brief period of discovery and ordered an evidentiary hearing on the issues raised in the motion. Following a two-day evidentiary hearing, the trial court granted the motion, set aside the jury’s verdict, and judgment, and ordered a new trial. The new trial is set to commence on June 1, 2020 in the Business Court in Oakland County.
