Altior Law attorney and shareholder, Jennifer Grieco, recently prevailed in an arbitration brought by Dr. Robert Shaner against his former employer, Rochester Community School District. The arbitration concerned claims that the Rochester Community School’s Board of Education breached Dr. Shaner’s employment agreement by constructively discharging him more than four years prior to the expiration of his employment contract. After a five-day hearing, the arbitrator agreed and issued his award finding “that the actions and inactions of the Board created conditions that were so intolerable that Claimant reasonably had no choice but to resign.” Such actions and inactions included failing to censure two Board trustees “attacks on Claimant’s integrity,” despite being “aware of the intolerable situations the attacks were creating for Claimant,” as well as the Board’s decision to discontinue Dr. Shaner’s salary and health insurance during medical leave. Through this conduct, the arbitrator awarded Dr. Shaner $732,631, concluding that the Board, “constructively terminated Claimant’s employment without cause and is responsible for paying his loss of income resulting from that constructive discharge through 2027.”
