Neuman Anderson, P.C., Prevails in Seeking to Have the Federal Court Declare Controversial City of Detroit Ordinance Unconstitutional

On February 22, 2016, Judge Nancy Edmunds issued her Opinion and Order granting Neuman Anderson’s Motion for Preliminary Injunction in the case of Floyd Hardrick, Jr., et al., v City of Detroit, et al. In granting the firm’s motion, Judge Nancy Edmunds struck a provision of the Detroit Animal Control ordinance, 6-1-2(e) as being unconstitutional on its face for permitting animal control officers to enter a residence or property without a search warrant, consent or exigent circumstances to take any animal that the animal control officers found on the premises. In granting this motion, Judge Nancy Edmunds rejected all of the City of Detroit’s arguments and sent a strong message that the City of Detroit violated these plaintiffs’ constitutional rights when their dogs were taken without a warrant, consent or exigent circumstances. See Opinion attached.
